PATENT OF INVENTION AND UTILITY MODEL


The form of the examining is testing (formal and material). The main Industrial property objects have the following terms of functioning:

- a Patent of invention - 20 years from the date of filing the application. For additional support, Annuities must be paid;
- an Utility model - 10 years (without the right of continuation). For additional support, Annuities must be paid;

The minimum of documents and data, required for immediate filing, receiving a date of a priority are:

- identification data of the Applicant: name, living place/office, origin, address, phone, fax , telex, sex, age;
- data for the real inventors if the Applicant is not the Inventor: name, living place/office, origin, address, phone, fax, telex, sex, age;
- name of the invention and description of the invention, revealing at least its subject.

Note: the description must be as complete as possible because the Patent law allows changes but does not allow escape from the original description. An additional extenuation means new application, new date of priority, new fees.

Obligatory documents, which have to be sent to the Patent Department in 3 months for legal application:

- one or more claims;
- schemes, if necessary;
- an essay;
- if priority is pretended, a declaration and priority certificate must be sent; for PCT application- the No and date of the application;
- an Attorney power form after a sample, signed for the Industrial property Representative and for the special object of protection;
- payment of state fees
